In a strongly worded editorial, The Washington Post today documented the tyrannical nullification of the First Amendment which Jack Smith attempted to impose on Donald Trump when Mr. Trump was running for a second term.

Then President Joe Biden and Attorney General Merrick Garland selected Smith, an undistinguished private citizen, to serve as a prosecutor of the former president for the kind of “WrongSpeech” which Hillary Clinton, Stacey Abrams, Hakeem Jeffries, Jerry Nadler, Maxine Waters and other Democratic Party deniers of election results have wantonly undertaken without fear of prosecution.

The Post, once America’s premier liberal newspaper after the New York Times has been in noticeable decline for several years. It is currently owned by Amazon billionaire Jeff Bezos who has thus far not managed to restore it to its once indispensable position as a primary news and cultural source. Perhaps today’s editorial is a first step in that direction.

Jack Smith’s conduct toward Trump reminds this writer of the arrogant tyrant Antoine Quentin Fouquier-Tinville, the public prosecutor at the head of Robespierre’s Jacobin French Revolutionary Tribunal in 1793, and Andrei Vyshinsky, the chief state prosecutor during Stalin’s infamous Moscow Show Trials of the 1930s.

Smith’s lone claim to fame? As a “war crimes prosecutor” in The Hague, a position he obtained through bureaucrats in the anti-free speech European Union.

His record as a prosecutor in the U.S. includes notable setbacks, including reversals by higher courts for which he was viewed with derision by independent observers and legal scholars.

For instance, Smith oversaw the prosecution of former Republican Governor Bob McDonnell of Virginia on federal corruption charges for accepting gifts and loans in exchange for official favors. McDonnell was convicted in 2014, but the Supreme Court unanimously vacated the conviction. The Court ruled that the prosecution’s broad interpretation of “official acts” under bribery laws could criminalize routine political courtesies.

Chief Justice John Roberts wrote the opinion, criticizing Smith’s theory as “boundless” and a threat to federalism. This reversal was widely seen as a major rebuke to Smith and damaged his credibility in public corruption cases, though it was no barrier to Biden and Garland selecting Smith to bring them Trump’s scalp.

I saw a similar Jacobin/Stalinist pattern emerge under President George W. Bush, in the person of his Secretary of Homeland Security, Michael Chertoff, who headed that police state bureaucracy from 2005 to 2009. Chertoff helped craft the USA Patriot Act which eroded Fourth Amendment protections against unreasonable searches.

As the head of Homeland Security Chertoff aggressively employed material witness statutes to hold suspects indefinitely when no criminal charges applied, bypassing normal due process — a loophole for prolonged detention without probable cause. As a senior Department of Justice official, Chertoff also lent moral support to CIA torture and kidnapping (”Enhanced Interrogation and Rendition”).

The main target of both Republican and Democratic tyranny is the First Amendment, often under a hate speech rubric. Last September Attorney General Pam Bondi distinguished hate speech from protected free speech: “There’s free speech, and then there’s hate speech, and there is no place, especially now, especially after what happened to Charlie in our society… We will absolutely target you, go after you, if you are targeting anyone with hate speech.”

The lady has no grasp of the Bill of Rights and our nation’s historic Constitutional protections for all political and religious speech, however much opponents may stigmatize it as hateful.

At present, most of the historically white nations of western Europe, as well as Canada and Australia, punish their citizens’ dissenting political speech with fines or imprisonment.

The Washington Post reported in December that “in Switzerland, Emanuel Brünisholz began serving 10 days in jail after refusing to pay a fine for a 2022 online post noting that human skeletons are either male or female — a biological fact — and asserting that transgender claims are a form of mental illness.”

New York Times’ accredited Orwellian “watchdog groups” scour the Internet for speech that offends their Leftist ideology. On December 31 the Times decried “...the relationship between the Trump administration and self-described citizen journalists,” citing Darren L. Linvill, an affiliate of an entity known as the “Media Forensics Hub “at Clemson University, which according to the Times, “tracks how social media is used to disseminate propaganda.”
